we're headed into another hot one but parts of the bay area catching a little bit of a break. take a live look at the temperatures. 65 degrees at livermore, already heating up ahead of the sun. >> and we have today's heat covered from all angles. christie smith is live at the bart station in oakland where the heat is having a big headache for riders. first jennifer hill has good news on relief from the heat. >> as warm as it is in places like livermore this morning, temperatures are a little cooler than they have been. in fact some fog being reported across the san francisco bridge this morning and thankfully at noon instead of the 90s in the east bay it's going to be in the 80s. 90s inland, 60s for san francisco, 75 in santa cruz. i'll come back with a look at the seven-day forecast and it's looking much better. >> thank you very much, jennifer. well, the heat not only making it miserable outside but for commuters stuck in cars, trains

or buses, it can be a rough one, kind of sticky. christie smith is live at a bart station where some riders are having a pretty rough time. good morning. >> reporter: good morning to you. yeah, they are. that's because some of these bart trains are getting kind of hot. if you want relief, the quickest thing to do is to jump into a car that is much cooler and doesn't make you sweat. before you do that, what you want to do is get on the intercom inside of the bart train and let the train operator know that the air conditioning isn't working in the car you're riding in. also let them know which car number you're in which is near the intercom by the door. that way they can get a technician to try to get it flowing again. they can get it fixed about 50% of the time rather quickly. they have had several heat-related delays particularly inland. about a third of bart's cars have had air conditioning that's been on the blink.

the heat causes computers in the control room and control boxes along the tracks to malfunction. there's kind of a domino effect. the control rooms are old and have no ac inside so that equipment is starting to break down more often and the boxes along the tracks control how fast the train moves. when they break, it becomes a mess. bart is trying to replace its trains in the long term, but until that happens, again what they're saying to do is get on the intercom and let the operator know what's going on so they can get a technician out there. on any given weekday they have five to seven technicians roaming to try to make a quick fix. christie smith, "today in the bay." the heat wave actually set some records for parts of the bay area. for example, san jose saw a high of 99 grows yesterday. that breaks a record of 95 back in 1946. normal high is around 79 degrees. that's about 20 degrees above

average. new developments this morning in the story that really started to come together overnight. scott mcgrew is in the newsroom with the latest on those developments. what are we talking about, scott? >> reporter: good morning, a terror plot was uncovered in europe, very early stages. this plot apparently targeting britain, france and germany, promising mass shootings. claims are the conspirators met in this mosque in germany. apparently connected -- this is connected, rather, to attacks in pakistan by american droughnes t we've been talking about all woke. a british intelligence official says some of the al qaeda officials that were hit. europe has been hit hard by muslim extremists. the 2004 train bombings in spain killed nearly 200, injured nearly 2,000. july 7th, the london train bombings, they call that 7-7 in

britain killed another 52. what we do know is there has been some sort of plot foiled but even the officials there say it was in the embryonic stage and not close to actually unfolding. also new this morning, the man set to take over bp this week has a new plan to avoid disasters like the gulf oil spill. bob dudley announced at that he's setting up a new safety division to track operations around the world. he replaced the much-maligned tony hayward friday. millions of dollars are headed to the south bay to help low income kids get the best education. rocketship education is one of four charter school networks receiving $20 million from the charter growth fund. the announcement will be made today as part of the largest fund-raiser for charter schools across the country. the rocketship education foundation website says the program has three elementary schools in san jose serving low income students. hundreds of bay area parents

will have to keep their kids home from school or drop them off at alternative day care. the state-funded child development agency kid dango is closing its 41 child development centers in the bay area today. the move is meant to call attention to the impact of the state budget delay. they are struggling to survive sips the state stopped paying for services at the beginning of july. child care providers, parents and teachers will hold a march in fremont as well as a noon rally in oakland. there are new rules in the east bay making it more difficult to smoke cigarettes or marijuana. people can no longer light up tobacco or medical marijuana in multi-unit housing complexes in unincorporated contra costa county. supervisors voted 4-1 to adopt those new rules. it means no smoking on balconies, patios, decks or car ports. it will also give landlords the right to evict somebody after three violations. fran police are on the hunt for a man accused of raping,

beating and robbing a woman. this is a look at the suspect, a 25-year-old on the run and considered dangerous. police say he's 5'8", 170 pounds and has an sf tattoo under his right eye. the attack happened on tuesday at a housing development on potrero hill. the victim is in stable condition. police are urging anyone with information to call san francisco police right away. the state is expected to appeal after fema rejected a request for millions of dollars in disaster aid. that money would have gone to investigate of the san bruno gas pipeline explosion. but fema says state and local governments and pg&e, which owns the ruptured pipeline, should cover the cost of recovery on their own. meantime an eighth person has been killed by the explosion. 58-year-old james franco died monday at san francisco hospital. congress is considering legislation to beef up pipeline safety, including more inspectors to search for corrosion. our mistake. that's the word from pg&e to

residents on the peninsula for failing to warn them about a problematic natural gas line near east palo alto. five pg&e representatives appeared before the city council last night to face their critics and apologize. the "daily news" reports the utility mistakenly listed a section of risky pipeline not in east palo alto. they reached out to other cities but didn't contact east palo alto. they are committed to improving communication with the city. california's new high-speed rail ceo will 55 his first bay area talk on the future of that project today. the proposed plan would allow riders to travel from san francisco to los angeles in less than three hours. now, the ceo will update how the $43 billion project is moving forward and how the state would benefit. the commonwealth club is hosting that talk at the rotary summit center in san jose this afternoon. pretty soon subway will be more than just a sandwich shop

in san francisco. the city's transportation agency will invite international contractors to compete to work on a nearly $2 billion central subway project. the mta says that that project will create thousands of new jobs and stations are expected to be built at five locations, including union square, chinatown and the must sconi center. so far no delays reported for any of our mass transit aemgz. if they build those stations, we'll have delays around those construction zones. the bay bridge, there is some unusual backup for 6:10 in the morning. we're seeing slowing on both side of the fastrak lanes. still a chance to beat those metering lights so get out there in the next 10 or 15 minutes if you can because they'll be turned on just about 6:25 in the morning. we'll look at a new accident in oakland that may affect your commute. this is westbound 580 at grand avenue as you're approaching

980. reports of an overturned volkswagen bug in the fast lane that will cause quite a bit of spectator closing. we may see more lanes blocked there. antioch, we have slowdown heading over towards horizon lane but an early slowdown towards pittsburg and bay point. still a chance to get to highway 4. we'll take you to interstate 80 as well without any major delays past that scene. livermore a little show but around airway boulevard we're starting to see slowing as well. so far things are moving pretty smoothly there. i'll show you the south bay coming up in the next report. meantime we want to check in with jennifer hill taking a look at the forecast. still hot out there but hope is on the way. >> yes. we're keeping it alive. that's all thanks to this high pressure, which has been pretty much parked and keeping us just with stagnant air is going to move away. that's going to allow more of a sea breeze to come in and our air conditioning, the natural air conditioning so we can turn off our air conditioners.

we'll feel it first along the area beaches, around the bay area and then move inland by this evening. also we're noticing some clouds coming up from this little low hanging out in southern california. it's brought in some clouds to the southern valleys and also off the coastline here. they're not producing any rain, maybe a little thunder this afternoon but not expecting any big rain coming your way any time soon. let's take a look at our 4:00 temperatures. finally instead of seeing triple digits in fairfield, livermore and concord, we're looking at temperatures in the 90s, which is an improvement. 68 in san francisco. redwood city will top out at 93 but eventually you'll feel cooler air coming in as well. that cooler air is going to feel great when we look at the seven-day forecast. a typical high this time of year is right around 80. we are still be running around average but it will be beautiful and comfortable. >> a little natural ac. it's 6:11 right now. getting down to business. the candidates for governor square off. what your vote could mean for bringing more jobs to the bay area. and a big win for some of

ticket prices rise. bob redell is live at at&t park to explain. good morning, bob. >> reporter: the san francisco giants are the only team fighting to get in the playoffs that uses dynamic pricing for its tickets, which means that throughout the season, the team will adjust its pricing based on supply and demand. supply and demand depends on factors like the weather, the pitching matchup, the day of the week and the importance of the game. with the giants ticket to the playoffs resting on this weekend's showdown against the padres, you better believe ticket prices are up for this weekend. for example, some of the cheapest seats in the park are in the left field upper deck. those were $5 at the start of the season. they jumped a buck at the start of september. friday the same seat has more than tripled in cost to $21. that's assuming you can get your hands on a ticket for that seat. the lowest price on the giants website they have for seats for this friday night matchup against the padres is $27, and

that's standing room. bloomberg news that this kind of dynamic pricing has certainly helped the team, increasing revenue for the giants this season by 7% to 8%. reporting live outside at&t park, bob redell, "today in the bay." >> thank you very much, bob. jobs took center stage during the first debate of the governor's race between meg whitman and jerry brown, particularly green jobs. attorney general jerry brown says the cornerstone of his economic plan is to make california the world leader in renewable energy. >> i have a very specific plan, and it's not to give a $5 billion tax break to myself, much less to the billionaires and millionaires. my plan is to invest in clean energy. let's invest in the jobs of the future. i did it before and i can do it again. >> whitman argued that afternoon needs to be more business friendly, especially in the private sector. >> the truth is, 3% of the jobs today come from green jobs, 97%

come from the rest of the economy. i want to focus on making sure that the employees who work for those companies don't lose their jobs. >> nbc bay area will host the final debate for the governors on october 12th. our coverage begins at 6:00 p.m. it is followed by the gubernatorial debate at 6:30 moderated by tom brokaw. post-analysis begins at 7:30. we'll stream it for you live on nbcbayarea.com as well. a court says federally funded stem cell research can continue while the government appeals against a total ban. in august a judge stopped federal funding for stem cell research saying that it violated a congressional ban. yesterday an appeals court panel ruled that funding can continue while the case works its way through the system. governmental lawyers said dozens of research projects would be ruined if that ban continued. the panel also ordered the case on a fast track but did not set a timeline for the next hearing.

a number of pharmaceutical companies in the bay area depend on stem cells and their work can do you continue. >> reporter: right. this case is about funding not about legality, so work can continue but california also has its own source of funding passed by prop 71 about six years ago. that set aside billions. in a strange way it would be advantageous if federal funding for stem cells ended. prop 71 proponents promised all kinds of miracle cures. we haven't seen any yet. there's only been one case leaving the lab for fda tests but a lot of basic science has gotten done. for what it's worth, new data from the census says one out of every 20 households in california has a millionaire living inside. 716,000 households. now, there are 514 million millionaire households in the u.s. most of them live in hawaii. which if i were a millionaire i'd be there too.

a few of them live in north dakota. >> aloha. it is too early to lift a ban on liquids on board flights. that is the word from u.s. homeland security secretary janet napolitano. she said she is surprised by remarks from the international civil aviation organization that security equipment in major airports would allow for the ban to be lifted soon. napolitano says, quote, i think that's premature. former president jimmy carter plans to go on with his book tour this morning after an upset stomach sent him to the hospital. carter is set to appear at two events in washington, including one at the smithsonian, to promote his new bok called "white house diary." he talked about it on the "today" show. he was on a flight from atlanta to cleveland when he got sick. rescue crews met the plane on the tarmac and took him to the hospital. the hospital says that he is fully alert and the decision to keep him overnight was just a precaution. 33 miners trapped

underground in chile may be rescued sooner than expected. drilling has been going very well and experts think they could be free as soon as next month. additional predictions had the rescue in november or december. but the three drills that are making the escape tunnels have worked twice as fast as expected and of course that's good news. you see the families celebrating there when they heard the news. the miners have been trapped underground 2300 feet below since august 5th. recovery in haiti is going very slowly, and critics say it's partly america's fault. nearly nine months after the devastating quake, not a cent of the $1.5 billion the u.s. has promised for rebuilding has arrived. the money is still tied up in washington. senators are not seeing eye to eye on the bill as a whole. the u.s. has sent $1.1 billion in post-quake relief. the number one public university in the country is cutting sports and it's all because of california's budget

crisis. cal is dropping baseball, men's and women's gymnastics, women's lacrosse and rugby. now, dropping baseball is really sad news for a program that has produced notable major league players like jeff kent. rugby is also very big at berkeley. he has won 25 national titles but it's going to be a club sport now. cal says that the cuts are needed to save $4 million. that's kind of stunning news for a lot of people, affects a lot of student athletes. we want to check the morning commute with mike. he said there's a problem in the east bay. >> we have a few problems now. we have an update to the problem i told you about, westbound 580 at grant avenue. overturned vw in the fast lane. reports are that is a non-injury accident, although an ambulance is headed to the scene and no major slowing, although it is blocking the fast lane in the commute direction through oakland. a new issue, northbound 880 and 5th where a big truck was blocked yesterday and caused big problems towards noon yesterday.

to the 100s. a big swing. >> yeah, even yesterday there was a 30-degree temperature difference within san francisco. it was 30 degrees cooler at the zoo that downtown. as we look at the bridge, it's all about the fog. we haven't seen a lot of fog across the rest of the area but that's just a sign things are cooling down. coming up we'll take a look at much better temperatures. well, the giants are heating up at the right time. they are two games up in the nr west but it's going to cost you some to see the games the rest of the season. bob redell is live at at&t park this morning with a lead-up to the playoffs. good morning. >> reporter: good morning to you, laura. we're talking about specifically the games this weekend against the padres. those games are crucial for the giants taking the national league west title. giants tickets are like shares of stock. the team adjusts the prices up and down based on supply and demand. with the giants on the verge of making it into the playoffs, you can bet that the prices are up this weekend. for example, you take the field

club seats located behind home plate. at the start of the season those were $68 a pop. $92 at the start of august. $130 a month later. if you want one of those seats for friday's game against the padres, it's going to cost you $175. more than double what it was at the start of the season. the team calls this dynamic pricing. i just checked with the giants website. the cheapest tickets available friday night, $27. that doesn't even get you a seat, that's just a place for you to stand. reporting live here outside at&t park, bob redell, "today in the bay." >> let alone if you want a hot dog to go with it, bob. bad enough. thanks a lot. convicted killer albert greenwood brown will stay on death row indefinitely unless the governor intervenes. governor schwarzenegger will appeal judge jeremy foggel's decision to delay brown's execution. it had been slated for this morning at 12:01 but was delayed until tomorrow night. now it's on hold indefinitely.

the judge said the state should not rush the execution before the courts can review the new death chamber procedures. we have a clearer view of where the candidates for governor stand this morning after their first debate. meg whitman and jerry brown went head to head last night. they tackled a number of hot button issues. coming up christie smith will have a look at who voters think will lead california after the november election. new this morning more people are blaming the president on the current state of the economy. an nbc news poll says despite the announcement that the recession ended in june of last year, only one in five people believe it's over. when asked if the president inherited the economic situation or it was due to his policies, 56% said it was inherited while 32% blame the policies. 10% say it's a little bit of both. that's a huge change from january, when only 16% said it was the president's policies. the very first census information is starting to come out and scott mcgrew ilooking

over some of the numbers an has interesting stuff for us. >> reporter: we learned interesting things about california. did you know while women still generally earn less than men, the difference is much closer in california than other states. the average man in the golden state makes $48,000 and change. average woman, $40,000. now, keep in mind we're not talking about the issue of equal pay for equal work, this is just average pay for the average person, no relation to work. among other data, we found fewer children in california are going uninsured. 43% of californians speak something other than english at home. the most expensive houses are in marin county. californians spend 26 minutes commuting each way and more people take public transit in san francisco county than anywhere else in california. here's a list you don't want to be on, a list of names of people who have downloaded adult movies from pirate sites.

that list, thousands of names, has been released to the public by an internet group. the names have been collected by an anti-piracy company which was trying to help the adult film industry fight illegal downloads. brent? >> while people in california fight over the fate of high-speed rail, china is busy setting new records. it now has the fastest high-speed train in the world, reaching speeds of almost 259 miles an hour. it's designed to kind of cruise along at 217, but it can go 259. china is also in the process of building a rail network over more than 68,000 miles, so they are getting after it in china. >> boy, mike, if you worked there you'd definitely have to get some new icons. >> faster moving chicklets as well. right now we're focusing on the very slow-moving red ones, speeds below 20 miles an hour. but this is actually better than

we saw ten minutes ago. i've seen speeds increase as two lanes are open. two lanes are blocked, your outer two lanes. southbound 880 at lewelling. spectator slowing around that interchange. keep that in mind. use mission boulevard and head over towards 880 a little further south. that will allow extra time despite that reroute off of 580. truck cleared from northbound 880 at 5th. there's an accident 580 at lake shore but that's not causing any major issues. the bay bridge toll plaza, there's your backup going back to west grand avenue. the metering lights are on. it's 6:36 and i'm sorry to have to tell you this, but it turns out one sex is more likely to apologize than the other. can you guess who? hundreds of bay area parents have to find new child care today. we'll tell you about the big protest that has some centers shutting their doors this morni

shooting a 12-year-old boy, but prosecutors may not charge her. police say the boy was throwing bricks at the woman's chicago home when she shot him yesterday. one brick went through her window. friends of the woman say the boy and friends have been terrorizing her and she came to a breaking point. the boy is in the hospital in serious condition. the woman spent the night in police custody and police are looking into whether it was self-defense. a new study shows that women are more likely to apologize than men and it's not because they're doing more things wrong or men avoid apologizing. >> canadian psychologists a men just see wrong in a different way. they don't find it necessary to say they're sorry. >> what's wrong with that? >> are you sorry for that? >> no. >> neither am i. the time now, 6:41. national happy hour. >> we're going to need one. >> we'll tell you where you can get a free beer later on tone.

buildings all across europe, and we are now just getting word that there are concerns of renewed plots in the united states as well. tracie potts is live in washington, d.c., with more on the potential targets and how that terror ring was stopped. >> reporter: good morning. authorities say the threat is not over, but they now know more about it thanks to a german citizen of afghan descent who was arrested in kabul over the summer and is talking. in fact authorities say he's talking a lot. apparently he and several others traveled from germany into afghanistan near the afghan-pakistan border in 2009 to join an extremist group that was linked with al qaeda. now he's telling authorities details of what was supposed to be a plot similar to the mumbai, india, deadly plot that killed several people, in fact 164, back in 2008. so here is what we know. the plan was to have a single shooter who would cause mass

casualties as part of this attack. they would hit financial targets like the eiffel tower or other well-known places like the eiffel tower, for example, in europe. this was signed off by osama bin laden. the person giving authorities this information is ahmed sedeki, a member of the german mosque that was one of the meeting places for 9/11 and also in the close cancel of mohamed atta, one of the 9/11 hijackers. u.s. authorities aren't commenting, saying they have no comment on specific intelligence, but authorities are saying that the threat is still out there, possibly not over. brent? >> thanks a lot for the update. welcome back, folks. we'll get a live look at the incline of the bay bridge. when the camera is turned over you know there's a problem on the that span.

westbound reports of a three-car accident somewhere around treasure island but it is moving off of the roadway. the volume of traffic is the reason why they turned on the metering lights. so the backup extending to the berkeley curve. the map shows slowing coming out of emeryville. on average your about a 22-minute drive from the carquinez bridge down to here. but that's the bulk of the slowing. more slowing here, westbound 580 at lake shore. two lanes blocked. despite this sig alert situation, no major delays but consider 880 a better avenue heading through downtown oakland. but southbound 880 a big problem. the accident cleared from the roadway. all lanes cleared but slowing from the area out of oakland up to lieueling boulevard so now it's about 27 to 30 minutes heading past 238. the benefit here for folks heading to the san mateo bridge, a lot easier drive here. now an issue in sunol. just before 7:00 is when we see the slowing approaching that

brown argued he would rather have a society where death isn't used as a penalty but agreed that the appeals process is too lengthy. >> i have been consistent that i will carry out the law regarding executions. secondly, as far as my support of law enforcement officers, it's reflected in the fact that the california police chiefs association has solidly, almost unanimously, endorsed my candidacy for governor. >> republican candidate meg whitman countered that brown has a history of being liberal on crime. >> and so actually the truth is he has been liberal on crime for 40 yeez. recently in the last week he's had a little bit of a change of heart on the death penalty saying, gee, i'm not morally opposed to it but for 40 years he has been morally opposed to it, so i think the record speaks for itself. >> on monday attorney general brown said he would stop state executions due to dwindling supplies of the lethal injection drug. so was there a winner last

night? well, i guess that depends on who you ask. christey smi is liie smith is l oakland and she's been asking some folks today. >> reporter: good morning to you. people here in oakland are obviously much more familiar with jerry brown because he was the mayor here. they recall his plans to bring housing downtown, his work with schools, but they're also telling us that doesn't necessarily give him a rubber stamp for this next job as governor. they do think he got in some good one-liners but they also feel like meg whitman made some very good points. they liked that they got her a chance to speak outside of the political ad format. many saying that's all they knew of her before. it was a spirited, hour-long debate where whitman stuck to the talking points from the campaign trail and brown put his quirky humor out there while also putting in some tough jabs at whitman. here's what commuters are saying. >> he's just too much of a

landslide we've been telling you about in mexico. you can see what the heavy rains did there. original reports said the slide buried hundreds of homes, killing at least 500 people, up to 1,000 were the early reports, but that's not the case. in fact just 11 people are missing and no one is confirmed to be dead. rescuers are there now. washed-out roads and damaged bridges really made it hard to get to that area. hundreds of bay area parents will have to find new day care today and they can thank the state budget crisis. kid dango is closing 41 centers in the bay area today. they say they are struggling to make ends meet after the state stopped paying subsidies this past summer so it's closing to call attention to the budget delay. child care providers, parents and teachers will march along mission boulevard in fremont and will rally at noon in oakland as well. meantime giants fans are thrilled and shocked this morning. thrilled that the giants are now two games up in the nl west.

>> and shocked at how much it will cost to see a game the rest of the season. bob redell is live at at&t park with a look at how much some tickets will cost you. good morning, bob. >> reporter: laura and brent, the san francisco giants is the only team fighting to get in the playoffs that uses dynamic pricing for its tickets. which means throughout the season the team does adjust the price of its tickets based on supply and demand. supply and demand, of course, depends on things like weather, pitching matchups, day of the week and the importance of the game. with the giants entry to the playoffs resting on this weekend, you better believe some of the prices are up. some of the cheapest seats in the park, left field upper deck, were $5 at the start of the season. they jumped a buck at the start of september. friday the same seat has more than quadrupled in price to $21. though i did go on the website this morning for the giants and those tickets did not appear to be available. you might be able to get them on
